Election day (Nov 8) is fast approaching and as a US citizen you are eligible to vote in the Presidential election no matter where in the world you reside with an absentee vote. Please check below for state specific deadlines for ballot registration and the date by when your registration must be received.
The Uniformed and Overseas Citizens Absentee Voting Act allows US citizens overseas to vote in the state where they last resided prior to departing the US, even if many years have elapsed, the voter maintains no residence in the state, and the intent to return to that state may not be certain. For citizens who were born overseas and have never had a US address, their voting address in the United States will be the last U.S. residence of a U.S. citizen parent.
A question we’ve been asked by many clients this year is whether registering to vote in a given state would automatically trigger state tax filing requirement.
Voting in an election for federal offices may not be used as the sole basis of determining residency for the purpose of imposing State and local taxes.
The U.S. Department of State confirms that residing abroad without a set date and intent to return to a particular State or to any State will not result in loss of U.S. citizenship. Therefore, selecting "I am a U.S. citizen residing outside the United States, and my return is not certain" will not result in loss of your U.S. citizenship.
For Uniformed Service personnel and their family members, your voting residence should be within the State listed on your Leave and Earnings Statement which defines your State for withholding State taxes. Don't confuse voting residence with home of record. Your home of record is the place you lived when you entered the military. It does not change while you are on active duty. Your voting residence may be the same as your home of record but needs to be updated if and when you decide to establish a new State of legal residence.

Uniformed Services voters and their dependents stationed in the United States only - South Dakota requires you to provide a photocopy of your valid ID. Acceptable ID is: A South Dakota Drivers License or non-driver ID card; a passport or other picture ID issued by the U.S. government; a tribal photo ID; a photo ID issued by a South Dakota postsecondary education institution. Should notarization of the stateside military voters signature be easier to obtain than a photocopy of the ID, a notarized absentee ballot application may be submitted. The notarization on the absentee ballot application can be administered by any commissioned officer in the military service of the United States.
Uniformed Services voters stationed overseas and overseas citizens do not have notarization or additional ID requirements. |
